Checklist for heirs of a property in Fuerteventura

1. Initial documentation of the causer

Before initiating any procedure:

  • Death certificate.

  • Certificate of Last Will and Testament (Ministry of Justice).

  • Authorized copy of the will (if any).

  • If there is no will, prepare a declaration of intestate heirs before a notary public.

  • DNI or NIE of the deceased.


2. Processing of the inheritance

To prove the hereditary ownership:

  • Deed of acceptance and adjudication of inheritance before a notary in the Canary Islands.

  • Inventory of inherited assets, including real estate.

  • Tax or expert appraisal of the inherited property.

  • Settlement of Inheritance and Gift Tax (ISD) at the Canary Islands Tax Agency.

    • Allowances applicable according to degree of kinship.

  • Payment of the municipal capital gain on inheritance (corresponding City Hall).


3. Registration and updating of the property

Once the inheritance has been accepted:

  • Registration of the property in the name of the heir in the Land Registry of Fuerteventura.

  • Updating of the Cadastre and IBI receipt.

  • Request for energy certificate (mandatory to sell).

  • Review of the legal and physical status of the property (mortgages, encumbrances, easements, etc.).
